NZXT Reaches $3.45M Settlement

PC hardware and rental company NZXT has agreed to a $3.45 million settlement to resolve a class-action lawsuit tied to its Flex PC subscription program. The company, operating in partnership with Fragile, was accused of defrauding 19,322 customers through deceptive practices.

Bait-and-Switch Allegations

NZXT marketed Flex as a "first of its kind gaming PC subscription service" promising high-performance PCs at low monthly fees with no long-term contracts, no cancellation fees, and regular upgrades. However, plaintiffs alleged the company delivered PCs with lower-quality components than advertised, and misrepresented key terms—including falsely implying the program was a rent-to-own arrangement.

As first reported by Gamers Nexus, the lawsuit states defendants "accomplished their PC rental scheme through a bait-and-switch" by advertising specific components but providing inferior hardware, while also misrepresenting program terms around ownership and fees.

Settlement Breakdown

The $3.45 million settlement is structured as follows:

  • Cash settlement fund: $1.45 million
  • Debt forgiveness: ~$923,000
  • PC retention relief: ~$1.2 million

Customers who have paid into the program for two or more years may keep their PCs. The settlement class covers U.S. residents who subscribed to the NZXT Flex Program between October 19, 2023 and March 30, 2026. Final court approval is still pending.

NZXT updated the Flex program in April 2025 to improve transparency, but the settlement addresses harm to existing customers.
